1. Acceptance of these terms

These Terms and Conditions govern your use of paintnowwnyllc.com and any forms, text messaging programs, or communications offered through it by Paint Now WNY LLC ("Paint Now WNY," "we," "us," or "our"). By using this site or submitting a form, you agree to these terms. If you do not agree, do not use the site.

2. Eligibility and age requirement

You must be at least 18 years of age to use this website, submit any form on it, request an estimate, or consent to receive text messages from us. By using this site or providing your phone number, you represent and warrant that you are 18 or older and that you are the account holder of, or have authority to give consent for, the mobile number you provide.

3. Text messaging program terms

Program description

Paint Now WNY operates two text messaging programs. Non-marketing messages relate to your estimate request, appointment scheduling and reminders, and updates about your project. Marketing messages include seasonal offers, discounts, and similar promotions. Each requires its own separate consent.

Consent

We text you only if you have given us permission. You may give permission by checking a consent box on one of our forms, or by telling us directly that we may text you. Consent to receive marketing text messages is not a condition of purchasing any goods or services from Paint Now WNY.

Message frequency and cost

Message frequency varies. Message and data rates may apply. Charges are billed by and payable to your mobile service provider. Paint Now WNY does not charge for text messages.

Opting out

Reply STOP to any message from us at any time to stop receiving text messages. You will receive one confirmation message, after which we will not send you further texts unless you opt in again. To rejoin, you must give consent again through one of the methods described above.

Carriers and delivery

Delivery of text messages is subject to effective transmission by your mobile carrier and is outside our control. Mobile carriers are not liable for delayed or undelivered messages. Not all carriers or handsets support all message types.

Privacy

Paint Now WNY will not sell or share your mobile phone number or SMS consent with any third party for marketing purposes. See our Privacy Policy for details.

4. Estimates, proposals, and pricing

• Submitting a form on this site is a request for an estimate. It does not create a contract and does not obligate either party to anything.
• Estimates are provided free of charge and are valid for the period stated on the estimate. If no period is stated, an estimate is valid for 30 days.
• Estimates are based on the scope of work observed and discussed at the time. Conditions discovered after work begins, such as rot, prior damage, or substrate failure, may require a written change order and a revised price.
• Work begins only after you accept a written proposal. The terms of that proposal, including scope, price, schedule, payment, and any warranty, govern the work and control over these Terms if they conflict.
• Paint Now WNY may decline any project at its discretion, including projects outside our service area or below our minimum job size.

5. Use of this website

You agree not to use this site to submit false or misleading information, to submit a phone number you are not authorized to provide, to interfere with the operation of the site, or to attempt to gain unauthorized access to any part of it. We may suspend or refuse service to anyone who does.

6. Intellectual property

The Paint Now WNY name, logo, and all content on this site are owned by Paint Now WNY LLC or its licensors and are protected by applicable intellectual property law. You may not reproduce, distribute, or create derivative works from this content without our written permission.

7. Third party links and services

This site may link to or rely on services operated by third parties, including advertising platforms and scheduling or messaging providers. We are not responsible for the content, practices, or availability of third party services, and their terms and privacy policies govern your use of them.

8. Disclaimers

This website and its content are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the site will be uninterrupted, error free, or free of harmful components. Nothing on this site constitutes a guarantee of any particular result, price, or timeline for a painting project.

This section does not limit any warranty expressly given in a signed proposal or contract for work performed at your property.

9. Limitation of liability

To the fullest extent permitted by law, Paint Now WNY LLC and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of this website or our text messaging programs. Our total liability arising from your use of this website will not exceed one hundred dollars ($100.00).

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

10. Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict of laws rules. Any dispute arising out of these Terms or your use of this website will be brought exclusively in the state or federal courts located in Erie County, New York, and you consent to the jurisdiction of those courts.

11. Changes to these terms

We may revise these Terms at any time by posting an updated version on this page and changing the effective date. Your continued use of the site after we post changes means you accept them.
